Basic Terms and Conditions

1. General

  • Rates are calculated at normal working hours unless to otherwise agreed.
  • Goods remain the property of Modac (Pty) Ltd until payment is received in full.
  • Goods returned will be subject to a 20% handling charge and/or an installation or de-installation charge.
  • We reserve the right to withdraw a quotation should it be accepted in part only. Should it be accepted separately or broken into parts, the installation prices will alter due to additional costs involved.
  • Contractual or tender details will be adhered to in conjunction with the contract between both parties. Any variations or alternative instructions will be charged accordingly.
  • Credit and any other background checks may be carried out on Modac (Pty) Ltd customers.
  • Staff and/or Contractors between the two companies will be off limits unless otherwise agreed to in writing.
  • Electronic copies of documents (e-mails, scans, faxes, etc) are acceptable as originals.

2. Additional Charges

  • Quotations are based on a visual inspection using information supplied, any additional costs arising from variations, hidden or unapparent obstructions, will be charged to the Customer accordingly.
  • Delays caused by any third party on site, lack of Customer co-operation or preparation, will be charged to the Customer.
  • Prices are subject to exchange rate fluctuations and are subject to the exchange rate at the time of delivery.
  • Cancelled orders will be subject to a charge of 20% of the total of the quotation up which the order was based.

3. Cabling Guarantee

  • The cabling installation guarantee is valid for 1 year, unless otherwise agreed.
  • The installation is guaranteed against faulty workmanship and materials, both of which will be rectified free of charge during this period.
  • This does not include damage by the Customer or any Third party, nor does it imply free maintenance.
  • Failure caused by acts of God and physical abuse are not covered by the Warranty.

4. Equipment Warranty

  • The equipment warranty is 1 year from date invoiced, unless otherwise stated.
  • The equipment is guaranteed against normal failure. Repairs to the equipment will be for Modac (Pty) Ltd account but any call-outs and /or transport costs will be for the customers account, unless a Maintenance agreement is entered into with Modac (Pty) Ltd.
  • Failure caused by acts of God and physical abuse is not covered by the Warranty.
  • Equipment under warranty must be serviced by approved technicians in accordance with product requirements to keep the warranty intact. Failure to do so will void warranty.

5. Battery Warranty Information

5.1 Lead-acid Batteries

Lead-acid batteries are designed for approximately 200 - 250 charge cycles. The 1-year warranty covers factory defects only, not normal wear from reaching the end of their cycle life.

Under frequent loadshedding (Stage 4 - 8 and above), batteries may reach their maximum cycles within a few months. Deep discharges below 50% or leaving batteries fully discharged for extended periods will also cause faster degradation.

5.2 Lithium Batteries

Products: Lithium battery LP1600 / LP1800 / LP1500 series.

Warranty Period:
LP1600 / LP1800 series: 5 years
LP1500 series: 3 years

Warranty conditions:
If any quality issue happened within warranty, we will provide full new battery or any components for you to repair, shipping / transport cost shall be undertaken by buyer.

Scope of the Factory Warranty:
The factory warranty does not cover damage that has occurred due to any of the following reasons:

  • Transport damage
  • Finished goods lost or serial number manipulated.
  • Incorrect installation or commissioning.
  • Failure to observe the user manual, the installation manual, or the maintenance instructions by authorised Agent.
  • Modifications, changes, or attempted repairs.
  • Incorrect use or inappropriate operation.
  • Using environment too bad (e.g., outdoor use, temperature over 25˚C).
  • Force majeure (e.g., fire, storm, etc.).
  • Overload or high usage.
  • Cycles over the stated number per C rating.
  • Neither does it cover cosmetic defects which do not influence the energy products.

The battery capacity after 5 years will be 85%, under required manufacturers conditions
Life cycles for 4000 is @ .5C Charge & Discharge, 80%DOD
Life cycles for 6000 is @ .2C Charge & Discharge, 80%DOD

Systems to be maintained by Modac, or a Modac approved agent, at a minimum of one per year. Onus on customer to arrange services within the stipulated time.

Modac to retain any old batteries when battery replacements are done.

6. Goods Returned

  • Goods supplied correctly as per the Customers order will be accepted back only if Modac (Pty) Ltd is unable to get the equipment working as per quotation.
  • Installation charges will be for the Customer account.
  • Goods must have original packaging.

7. Validity

  • Quotation is valid for fifteen (15) days from date of quotation or as otherwise stipulated.

8. Payment

  • Payment is due on presentation of an invoice or, for certain Customers having completed an approved Modac (Pty) Ltd credit application, 30 days from date of invoice. Claims do not exonerate the customer from payment of the goods when the relevant invoices fall due for payment.
  • Legal costs for the recovery of overdue payments will be for the customers account.
  • Prices exclude VAT unless otherwise indicated.
  • In accordance with the law, every payment must be accompanied by a remittance advice (a template can be sent upon request).

9. Order Numbers

  • No work will commence prior to the receipt of an official, valid order number.
  • Changes, variations and additional work will be invoiced separately and will require separate order numbers.

10. Ownership

  • Notwithstanding the delivery of any goods to the customer or their customer, ownership thereof shall not pass until Modac (Pty) Ltd has received payment of the full contract price.

11. Liability

  • Modac (Pty) Ltd does not accept any liability for damage (howsoever arising) to property, theft, loss of life, loss of business or any other consequential loss, due to any direct or indirect cause and the customer hereby indemnifies and hold blameless Modac (Pty) Ltd against any such claim.
